Expert Witness
We are trained and qualified to assist in dispute resolution and to assist in litigation over structural defects, easements or covenants, planning issues or questions over boundaries.
We can provide arbitration, expert witness reports and independent expert advice at any stage of a dispute. Our aim is to reach a settlement before the matter reaches court where professional fees and other costs may outweigh the benefit of any imposed settlement. If necessary, we are able to give evidence in court or at land tribunals and arbitrations.
Party Wall Agreements
The Party Wall Act covers three distinct types of work:
- Alterations to a shared (party) wall
- Construction of new walls on the boundary
- Excavation work close to neighbouring properties.
If you intend to carrying out building work which involves one these categories it is necessary to serve notice and obtain the affected Adjoining Owner's consent; if that consent is not forthcoming the parties are deemed to be 'in dispute' under the Act and surveyors must be appointed so that the dispute can be resolved by way of a Party Wall Agreement (technically called an 'Award').
Compensation
Where damage has been caused to a property, we can advise on any compensation due for remedial work. This applies mainly to end-of-tenancy disputes between landlord and tenant but may also apply in cases of third party damage caused to a building where insurance claims may arise.
We can inspect the property and prepare a schedule of dilapidations or damage and specify the works required to remedy the faults. You will receive a full report with a schedule of repairs required to put the property back into its original condition.
We also assist land and property owners affected by compulsory purchase. We will advise on the acquisition process and negotiate the relevant compensation.
